Terms of use

This Terms of Use Agreement (“Agreement”) governs the use of services (“Services”)provided on or in connection with the Breathe ESG website, located athttps://breatheesg.com/ (“Website”) and related web-based applications (collectively, the "Platform") operated by Breathe ESG ("Company," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by this Agreement and all of its terms without change.

1. Acceptance of terms

1.1 By accessing our Platform or using our Services, you agree to be bound by these terms of use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the Services or the Platform.

2. Eligibility

2.1 You represent and warrant that you are at least 18 years of age. If you are under the age of 18, you may not, under any circumstances or for any reason, use the Services.

4. Service usage and restrictions

4.1 You agree to use the Services only for purposes as permitted by this Agreement and any applicable law, regulation, or generally accepted practices in the relevant jurisdictions.

4.2 You agree not to (a) access (or attempt to access) the administrative interface of the Services by any means other than through the interface provided by Breathe ESG in connection with the Services, unless you have been specifically allowed to do so in a separate agreement with Breathe ESG, or (b) engage in any activity that interferes with or disrupts the Services (or the servers and networks connected to the Services).

4.3 You may not access the Services for the purpose of bringing an intellectual property infringement claim against Breathe ESG or for the purpose of creating a product or service competitive with the Services.

5. Content

5.1 All content posted or otherwise submitted to the Platform, is the sole responsibility of the account holder from which such content originates. You acknowledge and agree that you, and not Breathe ESG, are entirely responsible for all content that you post, or otherwise submit to the Platform.

5.2 Breathe ESG does not control user-submitted content and, as such, does not guarantee the accuracy, integrity or quality of such content. You understand that by using the Platform you may be exposed to content that is offensive, indecent or objectionable.

6. Intellectual property

6.1 The Service and its original content, features and functionality are and will remain the exclusive property of Breathe ESG and its licensors. The Service is protected by copyright, trademark, and other laws of both the India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Breathe ESG.

7. Payments and refund policy

7.1 Breathe ESG provides paid Services for which users need to pay with real money. These Services are subject to fees, taxes, and currency rates as stated on the payment page.

7.2 We don't offer refunds for our Services unless required by law.

8. Termination

8.1 We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9. Disputes

9.1 You agree that this Agreement is governed by the laws of the Republic of India and is subject to the exclusive jurisdiction of the courts in Bangalore, India, without regard to its principles of conflicts of law.

10. Changes of terms

10.1 We reserve the right to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
